CREDIT & COLLECTIONS
The Attorney/Client Fee Agreement establishes the initial credit terms (e.g. hourly, flat fee, or contingent and the appropriate retainer amount).  All accounts that accumulate charges without a retainer balance available to cover those charges are due upon receipt of an invoice.  All accounts with balances greater than 30 days past due will be considered delinquent and begin accruing interest at 18% annually.  Delinquent accounts are also subject to collections under our collections terms shown below.  All clients required to maintain a retainer balance will be notified that the retainer needs to be replenished upon being invoiced.

Full payment is expected upon receipt of an invoice.  If an invoice remains unpaid after 30 days, the account becomes past due and it becomes the duty of the Accounts Receivable Department to notify the client that their account is past due and accruing interest.  Once an account becomes 45 days past due, the collections process is initiated with a letter stating that payment in full is due immediately.  At 60 days past due, a Notice of Client’s Right to Arbitration will be issued and the attorney(s) handling the client’s matter(s) will be notified to discontinue services.  30 days after issuing a Notice of Client’s Right to Arbitration, a lawsuit will be filed for collection of money due.  At any time beyond 45 days, the account may also be referred to a collections agency.

All collection efforts outlined here will be charged to the client’s account in accordance with the Attorney/Client Fee Agreement.  When collection activities are unsuccessful due to bankruptcy or the inability to locate a client, the account will be placed for collection with a collections agency.
